Execution

Upon receipt of the documents from the purchaser’s solicitor, the vendor’s solicitor then proceeds to arrange for the vendor to execute them in his presence and duly attest his signature.

Following execution of the documents, the deposit sum is forwarded to the vendor unless the terms and conditions of the sale and purchase agreement dictate that the vendor’s solicitor has to hold the deposit sum as a stakeholder until the occurrence of a certain event.

It is prudent for the solicitor to collect legal fees and disbursement at this stage and issue a receipt so that the vendor can include the expenditure in reduction of the tax payable for real property gains tax.
