Essential preliminaries for a property WITHOUT title

The first step is to obtain all the relevant information from the vendor i.e.:

  1. (a) A copy of the vendor’s identity card and address;
  2. (b) All previous agreements beginning from the principal sale and purchase agreement [ie between the developer and first buyer] up to the present agreement;
  3. (c) All loan documentation and the details of the vendor’s present financier and loan account number;
  4. (d)The vendor’s income tax number and place of submission of the income tax form;
  5. (e) A copy of the current quit rent and assessment receipt;
  6. (f) Details, address and contact number of the developer/proprietor; and
  7. (g) All evidence of expenditure incurred by the vendor for the property.
  8. (h) Agreed selling price.

This information is then forwarded to the purchaser’s solicitor who proceeds to prepare the draft sale and purchase agreement.
