Professional Executors

If the executor is a professional such as a solicitor or accountant, he or she is entitled to charge professional rates only for those services which are professional services – professional and non-professional items of work are different. Where the solicitor has however acted in proceedings whether contentious or not, on his behalf or on behalf of his co-representative, he can seek the usual cost order (Practice Direction (1954) MLJ v).
