Role of a solicitor

The role of a solicitor in a conveyancing transaction would depend on which party the solicitor was representing in the transaction.

The solicitor for the purchaser has to ensure that the purchaser pays for the purchase price of the property in accordance with the terms and conditions of the sale and purchase agreement and most importantly to ensure the ownership of the property is transferred or assigned to the purchaser effectively in a legal manner according to the laws of the country.

It is also the duty of the solicitor for the purchaser to ensure that property is received by the purchaser free of encumbrances with vacant possession within the stipulated time period pursuant to the terms and conditions of the sale and purchase agreement, unless otherwise agreed upon.
